Various Roads, Maidstone in the Borough of Maidstone - Amendment 3: Waiting Restrictions

These Orders were proposed as Variation 49 and 49A but due to the recent Consolidation Order they have been renamed as above.

This order is an Amendment to the below order (variation 49) due to a road name error.

The effect of this made Order will be to introduce or amend existing waiting restrictions on the following lengths of roads in Maidstone in the Borough of Maidstone:

  • Headingley Road – on the southwest from its junction with Maxwell Drive for a distance of 19 metres in a north westerly direction
  • Maxwell Drive – on the west side from its junction with Headingley Road for a distance of 19.5 metres in a south westerly direction

This Order has been made for the following reasons:

  • for avoiding danger to persons or other traffic using the road or any other road or for preventing the likelihood of any such danger arising
  • for preserving or improving the amenities of the area through which the road runs
  • for facilitating the passage on the road or any other road of any class of traffic (including pedestrians).

The effect of this made Order will be to introduce or amend existing waiting restrictions on the following lengths of roads in Maidstone (double yellow lines waiting to be prohibited at any time):-

  • Ash Grove – on the southwest side between points 19 metres east and 19 metres west of its junction with Maxwell Drive
  • Howard Drive – on the northeast side between points 19 metres northwest and 20.5 metres southeast
  • Maple Avenue – from a point in line with the boundary of 36/38 Maple Avenue in a northwest direction following the kerb line around the turning head then a southeast direction to a point in line with the boundary of 31/33 Maple Avenue including the circumference of the central island
  • Maxwell Drive – (1) on both sides of its junction with Howard Drive for a distance of 21.5 metres in a north easterly direction (2) on both sides of its junction with Ash Grove for a distance of 19.5 metres in a south westerly direction.

  • for avoiding danger to persons or other traffic using the road or any other road or for preventing the likelihood of any such danger arising
  • for preserving or improving the amenities of the area through which the road runs

    Following the statutory consultation period, the scheme has been reviewed and the decision has been taken to make this Order permanent.

    Anyone may, by application to the High Court by 25 November 2024, challenge the validity of the Orders or of any provision contained in them on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or any instrument made thereunder, or that there has been a failure to comply with any statutory requirement to the Orders.
