Snodland Road, Birling in Tonbridge & Malling - weight and width restrictions

The effect of this made Order would be to extend the existing limits on Snodland Road in Birling to prevent any goods vehicles with a maximum permissible laden weight of which exceeds 7.5 tonne and a width limit of 6ft 6inchs to proceed in those lengths of road specified in the Schedule of the Order and exemptions are provided in the Order for; access etc.

This order is being made for the following reasons:

  • for avoiding danger to persons or other traffic using the road or any other road or for preventing the likelihood of any such danger arising
  • for preserving or improving the amenities of the area through which the road runs
  • for preventing the use of the road by vehicular traffic of a kind which, or its use by vehicular traffic in a manner which, is unsuitable having regard to the existing character of the road or adjoining property

    Following the statutory consultation period, the scheme has been reviewed and the decision has been taken to make this Order permanent.

    Anyone may, by application to the High Court by 25 April 2022 challenge the validity of the Orders or of any provision contained in them on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or any instrument made thereunder, or that there has been a failure to comply with any statutory requirement to the Orders.
