Public Bridleway AT32 (part) at Newenden Definitive Map Modification Order and subsequent Diversion and Definitive Map and Statement Modification Order 2023

Consultation has concluded

Kent County Council has received an application, and subsequently made an Order, to amend the legal record of Public Rights of Way, known as the Definitive Map, by amending part of the alignment of Public Bridleway AT32 at Newenden.

The Wildlife and Countryside Act 1981 states that the Highway Authority may make a Definitive Map Modification Order to amend the Definitive Map and Statement where there is evidence to show that the alignment of the public right of way has been recorded incorrectly.

The County Council has made an order after considering historical mapping evidence that showed it was reasonable to allege that the Definitive Map and Statement should be amended to delete the current recorded alignment of Public Bridleway AT32 (as shown by the bold purple line between points A-B on the Order plan) and to add a different alignment of Public Bridleway AT32 (as shown by the dashed line with cross bars in the intervals between points B-C in the Order Plan).

Subsequently, the County Council has also made an Order to divert part of the amended Public Bridleway AT32 at Newenden.

Under the Highways Act 1980, an Order may be made to extinguish or divert a Public Footpath, Bridleway or Restricted Byway where it is in the interests of the landowner and/or the public to do so. In considering a proposal, the County Council will have regard to whether the new route is substantially less convenient to the public and the impact of the proposed diversion on the public enjoyment of the route as a whole.

    The above Orders were confirmed on 02 January 2024 and have now taken effect.
