Footpaths MU98, MU99 and MU100 at Tonbridge Definitive Map Modification Order 2020

Kent County Council received an application, and subsequently made an Order, to amend the legal record of Public Rights of Way, known as the Definitive Map, by recording 3 Public Footpaths numbered MU98, MU99 and MU100 at River lawn, Tonbridge.

Under the Wildlife and Countryside Act 1981, the County Council may make an Order to modify the Definitive Map where it is considered that a public right of way which is not shown on the map is reasonably alleged to subsist.

As an objection to the Order was received, a submission was made to the Secretary of State, who considered the evidence and has subsequently confirmed the Order.

This Order became operative as from 6 September 2022 but if a person aggrieved by the Order desires to question the validity thereof or of any provision contained therein on the grounds that it is not within the powers of Section 53(3)(c)(i) of the Wildlife and Countryside Act 1981, or that any of the requirements of Schedule 15 to the Act have not been complied with in relation to the confirmation of the Order, they may, under Paragraph 12 of Schedule 15 to the Act, within 42 days from 30 September 2022 make an application to the High Court.
