Public Footpath MT18 (Part) Hildenborough Definitive Map Modification Order and Subsequent Diversion and Definitive Map and Statement Modification Order 2023

Kent County Council has made an Order to amend the legal record of Public Rights of Way, known as the Definitive Map, by amending part of the alignment of Public Footpath MT18 at Hildenborough.
The Wildlife and Countryside Act 1981 states that the Highway Authority may make a Definitive Map Modification Order to amend the Definitive Map and Statement where it is considered that a public right of way which is not shown on the map is reasonably alleged to subsist.
The County Council has made an order after considering historical mapping evidence that showed it was reasonable to allege that the Definitive Map and Statement should be amended to delete the current recorded alignment of Public Footpath MT18 and to add a different alignment of Public Footpath MT18.

Subsequently, the County Council has also made an Order to divert part of amended Public Footpath MT18 at Hildenborough.
Under the Highways Act 1980, an Order may be made to close or divert a Public Footpath, Bridleway or Restricted Byway where it is in the interests of the landowner and/or the public to do so. In considering a proposal, the County Council will have regard to whether the new route is substantially less convenient to the public and the impact of the proposed diversion on the public enjoyment of the route as a whole.
