Public Footpath KM348 at Bearsted - Definitive Map Modification Order 2021

Consultation has concluded

Kent County Council has received an application, and subsequently been directed by the Secretary of State, to make an Order to amend the legal record of Public Rights of Way, known as the Definitive Map, by recording a new Public Footpath at Bearsted Green.

Under the Wildlife and Countryside Act 1981, the County Council may make an Order to modify the Definitive Map where it is considered that a public right of way which is not shown on the map is reasonably alleged to subsist.

The County Council has been directed to make the Order following a successful appeal under Schedule 14 of the Wildlife and Countryside Act 1981 against the County Council's original decision not make an Order.

UPDATE: This Order has now been confirmed and has taken legal effect.

A copy of the confirmed Order and the Planning Inspectorate's Decision may be viewed in the 'Documents' section.
