Restricted Byway HE378 at Paddlesworth, Hawkinge and Newington - Definitive Map Modification Order 2025

Kent County Council has received an application, and subsequently made an Order, to amend the legal record of Public Rights of Way, known as the Definitive Map and Statement, by recording a Restricted Byway running between Fishers Lane at Paddlesworth and Elvington Lane at Hawkinge.

Under the Wildlife and Countryside Act 1981, the County Council may make an Order to modify the Definitive Map where it is considered that a public right of way which is not shown on the map is reasonably alleged to subsist.

Please note that the Order has been made at Restricted Byway status on the basis that any pre-existing rights for mechanically propelled vehicles have been statutorily extinguished by virtue of section 67 of the Natural Environment and Rural Communities Act 2006.
