Restricted Byway EE503 at Nonington Definitive Map Modification Order 2025

Kent County Council has received an application to amend the legal record of Public Rights of Way, known as the Definitive Map and Statement, by recording a route at Restricted Byway status running between Sandwich Road and Grannies Lane at Nonington. Restricted Byway status provides a public right of way on foot, on horseback, by bicycle and in a non-mechanically propelled vehicle.

Under the Wildlife and Countryside Act 1981, an Order may be made to modify the Definitive Map where it is considered that a public right of way which is not shown on the map is reasonably alleged to subsist.

In this case, the County Council has been directed to make a Definitive Map Modification Order by the Secretary of State following a successful appeal (by the applicant) against the Council's original decision to decline the application to amend the Definitive Map. The Order will only take effect if it is confirmed; making and advertising the Order provides an opportunity for objections and representations to be made.

UPDATE 09/09/2025: Due to objections received, the matter has been referred (as required) to the Planning Inspectorate for determination. Relevant information will appear in the Documents section as and when it is available.
