Restricted Byway EE323 at Nonington Definitive Map Modification Order 2025

Kent County Council has received an application to amend the legal record of Public Rights of Way, known as the Definitive Map, by upgrading Public Footpath EE323 at Nonington to Restricted Byway status. Restricted Byway status provides a public right of way on foot, on horseback, by bicycle and in a non-mechanically propelled vehicle.

Under the Wildlife and Countryside Act 1981, the County Council may make an Order to modify the Definitive Map where it is considered that a route shown at a particular status ought to be shown at a different status.

In this case, the County Council has been directed to make a Definitive Map Modification Order by the Secretary of State following a successful appeal (by the applicant) against the Council's original decision to decline the application to amend the Definitive Map. The Order will only take effect if it is confirmed; making and advertising the Order provides an opportunity for objections and representations to be made.
