Diversion, Extinguishment and Creation of Public Footpath CH45 at Herne and Broomfield Confirmed Public Path Orders

Kent County Council has received an application (on behalf of Canterbury City Council), and subsequently made, confirmed and certified an Order, to divert part of Public Footpath CH45 at Herne and Broomfield.

Under the Town and Country Planning Act 1990, an Order may be made to close or divert a Public Footpath, Bridleway or Restricted Byway where it is necessary to do so to enable development to take place.

Kent County Council has also received an application, and subsequently made and confirmed Orders, to extinguish and create part of Public Footpath CH45 at Herne and Broomfield.

Under the Highways Act 1980, an Order may be made to close a Public Footpath where it is considered to be no longer needed for public use and may create a new route if it is considered that the new path would add to the convenience and enjoyment of the public.
