Public Footpath AE464 (Part) Diversion and (Public Footpaths AE466 and AE467(Part) Aldington - Extinguishment Orders 2022

Kent County Council has received an application, and subsequently made an Order, to divert part of Public Footpath AE464, and extinguish Public Footpath AE466 and part of Public Footpath AE467 at Aldington.

Under the Highways Act 1980, an Order may be made to divert a Public Footpath, Bridleway or Restricted Byway where it is in the interests of the landowner and/or the public to do so. In considering a proposal, the County Council will have regard to whether the new route is substantially less convenient to the public and the impact of the proposed diversion on the public enjoyment of the route as a whole.

On order to extinguish a public footpath can be made if the path is deemed as not needed for public use.

    On the 22 June 2022, Kent County Council confirmed the above Orders under sections 118 and 119 of the Highways Act 1980.

    The Orders came in to force on June 22, but if a person aggrieved by the Orders wants to question its validity, they can make an application to the High Court within 6 weeks from the 08 July 2022.
